Filling-in HA32

Notes at top You should read the notes carefully and fill the form in as they say.

To Insert the name of the tenant. If there is more than one, give the names of all the tenants.

Address Insert the address or identifying description of the property as it is stated in the agreement form which has been signed.

Grounds relied on You must look carefully at the wording of the different grounds set out in Schedule 2 to the Housing Act 1988 as amended by the Housing Act 1996 to see which ones you can rely on. Do not forget to copy out the statutory words on to the form.

Note: You should also read carefully the notes at the bottom of the first page which are addressed to the tenant.

Explanation State here why you say the words of the Act are satisfied. For example:

"The rent is payable monthly and I have not received any rent from the tenant for more than three months. The last payment made was on [date]."

"Under the agreement the tenant agreed not to do anything which might be a nuisance to, or might cause annoyance to, the tenants or occupiers of any adjoining premises. I am also the landlord of three other flats in the same building and the tenants of all of them have complained to me on numerous occasions that the tenant of the property plays very loud music all evening up until 1 a.m. The local authority also wrote me a letter dated [ ] stating that they had received complaints from the other tenants and had measured the volume of noise at a level which they regarded as a nuisance."

Earliest date Read the notes carefully to make sure that the date you insert is one which the Housing Act allows you to specify.

Name and address Make sure that you read the notes and complete all parts of section 8 of the form in accordance with the instructions given.
