Enterprise Act 2002
Certain Rules have amended existing Insolvency-Partnership forms 1 and 4 and prescribed two new forms, 1A and 1B, for use in winding up insolvent partnerships under the Insolvency Act 1986.
These amendments flow from the changes introduced under the Enterprise Act 2002. In particular, they make provision for companies to go into administration by court order on an administration application or upon the appointment of an administrator by the company, its directors or the holder of a qualifying floating charge, rather than by making a petition for a winding-up order.
I-P1A is a new form which members of a partnership serve, indicating their intention to appoint an administrator of their partnership.
I-P1B announces the appointment of an administrator of the partnership where I-P1A has not been issued by the members of the partnership
NEW AND AMENDED FORMS WILL BE AVAILABLE IN EARLY JULY. CURRENT VERSIONS OF I-P1 AND I-P4 SHOULD NOT BE USED AFTER 30TH JUNE.
